Yeah I agree tenant must be deeply informed about all the right options available in the market, so that they can take an informed decision as ending in choosing a wrong property can have lot of indirect repercussions on the business.

I've been in the market actively leasing spaces since the age of 18, first for my family and friends and as my understanding of the Real estate industry grew for my self owned spaces! Here are my two cents to help you make sense of this jigsaw puzzle known as Commercial Leasing:_ 1. Ensure your product is the right fit for the consumer. Rather than shoving your space down the prospective clients throat find out their pain points. What do they really need? This will help you tailor your proposal to suit their needs. Pun intended. 2. Secondly, where are they operating from currently and why do they need to move out? This helps you understand whether they are expanding, downsizing or simply upgrading. This further distills your strategy!!

Occupier tenants have a fiduciary responsibility to stay on top of real estate markets across the globe so as to provide the best advice to a growing business. Equally important is the need for accurate data that is independent, or at least verifiable, of the brokerage and developer industries reports. Occupiers must always remember that real estate is a perception market for the most part, especially in urban markets.

Leases can be really complex to navigate for a first timers and daunting to even the most experienced when dealing with a skilled corporates. Stick to a basic starting point and go from there. 1. Term - 5 year agreements and minimum 3 year lock-ins are the norm. Deviating from this will lead to a lot of pain. 2. Deposit - Depending on the investment its best to keep a sizable deposit of 6 months to ensure the lessee has skin in the game. 3. Rental - Larger companies demand a discount when they pick up space in bulk. Be ready to discount if you want "brand names" in your building. 4. For built to suit furnished - Ensure deposit is taken and layouts and specifications are frozen well in advance. This can save major headaches later.

It is true that leases are very complex agreements that can be difficult to execute. Generally, it is incumbent on the Occupier to ensure the lease is very detailed and thorough to avoid potential later conflicts and to enable the organization to plan around business needs going forward. I recommend first knowing what your core business may need during the term of the lease and ensure those elements are programmed into the lease in detail. Avoid being forced into a “standard” lease as these generally favors the landlord.

Negotiating a lease is pretty straight forward. Here are the basics. 1. First ensure they are really interested and not just "fishing" 2. Don't reduce your rates right away. First give them your starting figures and let them get back to you. Keep the ball in their court as much as possible. 3. Check the tenant quality and the expected density they want to fill your office space with. Be ready to walk away from a deal if they are paying a handsome sum but are trying to convert your beautiful office into a "Call Center / BPO" unless the building is specifically designed for such heavy density. 4. Finally try to find a win win situation by changing yearly increment rates or deposit amounts as per your comfort.

There is some truth to the introduction, just keep in mind that ‘landlord constraints’ are not nearly as limited as they would like you to believe. That being said, landlord should profit from the exchange or go out of business. To arrive at the best deal, I tend to engage as many landlords that meet my site selection criteria and work on arriving at a initial deal. When going to market, in most cases, you are working with your occupier broker, landlord’s broker and perhaps a number of other entities that are incentivized to make a deal (i.e. sigh the lease). That does not mean the deal is good for your business…

Its not just about the Rent! 1. Property taxes are generally paid by the Lessor. It's just better from a legal standpoint. 2. Monthly society Maintenance can be heavy depending on the grade of the building and the amenities. Ensure defaults on maintenance paid by tenants lead to contract termination too. 3. Electric / Water bills must be paid by the tenants and defaults on these too must have implications stated clearly in your contract. 4. Repairs must be segregated into minor and or major repairs. Ownership of these must be stated clearly especially when it comes to Furnished / Fitted out spaces.

How they use your space is equally important! 1. Ensure the type of usage and its limitations are clearly mentioned in the agreement. A Commercial space used partly for a residence can become tricky when it comes time to vacate the tenant. 2. Change of use can affect property tax. Surprise visits by your local council can adversely affect your property. 3. Changes in fire and electric works must be done with your consent and adhering to local byelaws. 4. Civil work changes to the main structure and RCC must be prohibited at all costs! It could lead to the collapse of the entire building due to your space.

I want to add important element in leasing. Maintaining good relationship between owner and lease holder will always be a problem. There should be a strong binding with the legal support for long standing understanding on both sides

The introduction statement is a great start! This is why it is critical for CRE executives to understand the core business they support in as much detail as possible in order to ensure needs are met and the future is planned for. Know what options you may need in your lease and when they might be needed. For example, ROFO/ROFR clauses can be misleading as the landlord controls the timing. Asking for a building stack plan with lease terms has allowed me to schedule my ROFO/ROFR clauses to my corporate benefit.
