Make sure you understand what rights you're automatically entitled to and what you might be giving up when entering agreements. Start by thoroughly reading and understanding all contract terms before signing anything. Look for clauses related to ownership, licensing, and usage rights of your content. If a contract seems ambiguous or overly restrictive, don’t hesitate to ask for clarification or negotiate terms that better protect your interests. If your creative output is original/ novel in concept and design and could be monetised through licensing, redistribution, etc. Consider if obtaining a patent would put you in a stronger position to protect your intellectual property. There will be a greater imperative to ensure you protect the value generated from a patent.

It's important to note that while copyright applies as soon as someone fixes an original work of authorship in a tangible medium of expression for more than a transitory duration, you can't enforce your copyright in federal courts until you've registered it with the copyright office.

So many creators (and other folks!!) sign agreements without having an attorney review it or at the minimum carefully reading it themselves. This can really hurt a creator because an agreement not only governs the relationship between 2+ parties for the endeavor they're undertaking together, but it can affect that creator's content, which is EVERYTHING, beyond the intended term of the agreement itself. Creators: PLEASE do yourself a favor and either have a lawyer you trust take a look at all of your agreements or at a minimum read every word of the agreement and do research wherever you feel lost.

Many organisations will seek to minimise or reduce their obligations for the safe and secure use of their products and services because the quality of the product or service offer too much risk. Check to make sure that your organisation is not absorbing excessive risk and offsetting the providers risks. Only organisations providing robust products and services are prepared to offer adequate indemnity and take liabilities for those offerings.

Keep detailed records of all negotiation discussions and agreed-upon changes. This documentation will serve as a reference if disputes arise and can help ensure that both parties adhere to the revised terms.

Contracts aren’t a “take it or leave it” deal. If something feels restrictive, speak up. You have leverage as a creator, especially if your content has value. Whether it’s retaining certain rights or securing better compensation, don't be afraid to negotiate terms that work in your favor.

Instead of giving up ownership, consider licensing your work. Licensing allows others to use your content under specific terms while you retain ownership. This strategy lets you keep control over how your work is used while also creating additional revenue streams.

Note that granting someone an exclusive license means what it says: you're also not able to exercise the licensed rights for as long as the license lasts. Exclusive licenses can be very similar to assignment of rights.
