The key to resolving misunderstandings is to attack the root of it. No matter how legally trained a person is, some interpersonal elements are quite essential in high-stakes contract negotiations.

The real problem here is that one party loses face when they realise they were wrong on the point. When you see this unfold, immediately adopt the error as your own (even if it isn't). Apologise and ask permission to give more context. That looks like, "Oh sorry! I didn't articulate that very well. Is it OK if I give a bit more context? I think we might be on the same page here, but I just need to clarify if I've understood things correctly." ... The next step is to use a combination of explaining and cap in hand questions to guide the person to your line of thought. For example: "I thought because XYZ it meant ABC. Am I off track?" The key is to ventilate the issues while preserving the person's ego and avoiding loss of face.
