#The Role of IP in harnessing the value research The need to protect innovations and inventions cannot be overemphasised, especially at this moment when India is poised to take a leap into the innovation century and breach barriers like never before. We need both offensive and defensive strategies for protection of IP. We need to deploy IP at the inception of research to achieve the coveted result of commercially viable result which is patent eligible and also ensures market exclusivity, not for a day for years. Cultivating scientific temper, the focus and determination to make it, develop the best technologies should be the hallmark of our thinking.

Ideally, one would need to know IP rights and laws in all the jurisdictions involved in international research collaborations as well as the risks involved in data sharing and communications containing commercially sensitive information. It is an extremely demanding task which needs expert guidance and advice.

To best protect innovations using IP, and R&D outcomes in particular, I think a good knowledge and understanding of the subject matter, or at least the field of innovation, is needed. Next, one should identify and define - preferably with the R&D people - the innovative deltas from what already existed. Once these are clear, a combination of experience with the various applicable IP tools and understanding the client's/applicant's business environment and goals may be collectively leveraged to generate valuable IP.

We must to know what is the trend in the future and what is your business core value and competitive company have defined their intellectual scope. What are the next generation or steps? They should input form our customers, specialist and RD innovators.

The IP should be made more stringent so that the researchers and innovators should feel more safe while sharing their work. This will help is more interaction between the researchers.

Documentation is the cornerstone in the complex realm of R&D and IP management. It serves as the DNA of your innovation, capturing its essence and evolution. Communication skills are crucial in the intricate landscape of R&D and IP protection. They serve as the vital link among diverse stakeholders: team members, partners, customers, suppliers, investors, and regulators. Effective communication turns strategic IP goals into actionable plans, aligning everyone to safeguard your intellectual assets. This skill is key in crafting and negotiating IP agreements like licenses and NDAs. While documentation forms the bedrock of your IP strategy, communication is the cornerstone that makes everything coalesce. If documentation is the product, then communication is the indispensable process that orchestrates it all.

What I have been working on during the past few years is improving my skills in asking questions, especially in asking follow-up questions in ways that encourage others to provide more data and information. I have learned a lot about the science of asking questions but still have a lot to learn.

Communication skills, enjoyment and laughter are the cornerstones are crucial. They are very important to keep all stakeholders informed and interested and manage success and when things do not go by the plan alike.

Research skills are the bedrock of both generating and protecting R&D intellectual property. Without the ability to do thorough research the point of generating IP is moot. Only through research one can ascertain the gaps in knowledge or applicability thereof to develop a certain IP. Developing research skills also need training and domain expertise that would allow development and protection of IP in highly complex and technical fields.

Innovation is not a “skill”. You have to find the rare people who actually have the ability reconceptualize the entire problem. This is analogous to Kolmogorov complexity - there is no algorithmic way to find the most concise way to encode some information. The same way, there is no learnable “skill” to finding a better conceptual foundation to comprehend some particular phenomena of interest in a completely new way.

You can’t foster innovation by hiding away people in a lab. They need to visit customers and other locations, attend conferences and universities and free time with other creative people to discuss and collaborate on ideas, emerging technologies and market needs. Brainstorming methods work with the most in R&D. Asking people after a presentation of their work for any new ideas, or interesting projects tells then you care about creativity.

There is fear amongst many innovators that the patent will reveal everything and it will become open secret. Not so if you know how to hide.

IP protection is a set of tactics wrapped up in strategy. Articulating an innovation, documenting it and getting a good patent are only part of the challenge. Patents give you the means to sue infringers. Detecting infringement and protecting IP are the asignee's challenge. Strategy - combining inventions, claims, trade secrets, NDA's contracts and negotiated third party rights, etc to create a strong IP "wall". Tactics - the inventions, claims, NDAs, secrets etc feeding the strategy plus methods to detect and enfirce infringement. Insights - understand not only what us patentable, but what can be enforced, and how IP works across int'l borders.

You should know the scope of your intellectual property and the uniqueness it confers on products and/or processes. You should also have good communication and networking skills and be conversant with the activities in your profession, including attending major conferences and keeping up-to-date information on changes in products, production, and manufacturing processes. Groundbreaking activities are often discussed in top seminars, conferences, and workshops. Sometimes, simply knowing the entities involved in some activities and the challenges they faced can raise some suspicions. Often you would ultimately need to engage the services of licensed patent attorneys/professionals to unearth any infringements and to sue for restitution.
