The benefits of IP (Intellectual Property) are obvious. The key question is: will this IP bring tangible business value that justifies the cost? Will it create a defensible and adequate moat around which you can build a viable business? A good part of the answer should be based on what you plan to do with the business: sell it, license it or stick with it to the end. Patents aren't cheap and poorly written ones can get tossed easily. Defending them incurs significant legal fees & angst. You can't just throw your idea at a patent agent and expect defensible or useful IP. You must participate. One should have in mind not just the technical nature of the invention, but how the IP will be strategically used and tie into one's business plan.

As entrepreneurs we are often pushed to create IP. If you've never done this before your first step is to locate a patent agent or lawyer. In considering outside help such as this, an often overlooked characteristic is strategy for IP. It takes some skill to properly translate your invention into the language of patents. But a patent person who also listens, understands and incorporates your business strategies into that language can give the IP more value and strength. It behooves you to at least learn how and why patent language is different and done the way it is. You are writing a legal document that WILL be challenged immediately and later on. If you don't understand it, how do you know it has value worth defending?
