1 What is a DPO?

A DPO is a person who is responsible for overseeing the data protection strategy and implementation of an organization. A DPO may be an employee, a contractor, or an external service provider. 2 Why do you need a DPO?

Depending on the nature and size of your organization, you may be legally required to appoint a DPO. For example, under the GDPR, you need a DPO if you are a public authority, if your core activities involve large-scale processing of special categories of data or data relating to criminal convictions and offences, or if your core activities consist of regular and systematic monitoring of data subjects on a large scale. Even if you are not obliged to have a DPO, you may still benefit from having one, as a DPO can help you demonstrate accountability and transparency, enhance your reputation and trust, reduce risks and costs, and improve your data governance and quality.

Based on the business structure, you may want to implement a more tiered approach to your function. Employ privacy officers or privacy experts who will help you with the day to day implementation of your privacy program. This leaves you as a DPO with the time and resources to actually see and work on what matters from a higher perspective. No sense in tying down your time with manning the privacy inboxes or reviewing privacy questions from teams within the business. Let your Privacy Officers do that.

Apart from ensuring that data processing copies with all applicable laws, I think the most crucial task of a DPO is to establish a culture of privacy within the organisation. This can be achieved by continuous capacity development and awareness of all the employees.

The UK guidance may be used as a template however care & discretion should be used to ensure it meets your own organisations, industry, local, regional or other stakeholder requirements.
