Under the GDPR in EU/EEA biometric data can only be processed if the Processor has acquired a clear and informed consent for the intended processing of biometric data. It is therefore important to transparently inform about the intended processing and the purposes involved while acquiring consent. If the Processor acquired the biometric data without consent or for incompatible purposes, they run into a huge risk of prosecution and/or liability for damages, due to processing personal data without legal basis. Based on previous judgements, European supervisory authorities and courts don't mess around here.

I agree with the general premise that businesses, particularly Customer's of "as a service" technology providers, carry additional risk by processing personal data through AI but if businesses are already compliantly managing and monitoring their personal data, under any applicable data privacy law, they will be able to manage to the additional rules that privacy authorities release as AI becomes the next advancement in technology and thereby personal data processing. The weakness we see is in corporate responsibility to manage and monitor an individual's personal data and ensure that it is protected in accordance with the individual's choice.

For example, research done by the U.S. National Institute of Standards and Technology has found that most facial recognition technologies perform worse on faces that are non-white. Higher false positive rates are experienced by Asians, African Americans and Native Americans in algorithms that engage in 1:1 matching, which is a technique to match a photo of a person to another photo of that same person in a database. African-American women have also been shown to have particularly high false positive match rates, “which puts this population at the highest risk for being falsely accused of a crime.”

There are more laws that are being proposed such as the EU AI Act and US States biometric laws. While the US laws are not as comprehensive as the EU AI act, it is a step in the right direction and hopefully large companies like Google and Microsoft will take a similar position as they did with GDPR by implementing it not just for EU citizens but for all of their customers worldwide.

One of the major weaknesses in personal data processing today, is the business' data processing professionals conflate security standards that protect business confidential information with privacy regulations that protect an individual's personal data regardless of the technology it is being processed on. There are methods under any privacy regulation that allow businesses (business/controller; service provider/processor) to compliantly process personal data of an individual. The design of the technology processing the personal data matters but more importantly the facts of the personal data processing indicate whether a business is compliant in the processing.

A fourth data privacy risk in AI-driven facial recognition and biometrics is the governance and regulation of data. Laws across jurisdictions vary, with some regions having stringent privacy laws like GDPR or CCPA. However, these may not comprehensively cover all aspects, and enforcement and compliance issues may lead to potential misuse, such as mass surveillance or political repression without proper oversight and transparency.

Please stop saying data privacy… Please train your AI model better… And see here one of the ‘risks’ of using AI: it contains flaws and bias and will, in the case of using it for facial recognition, lead to false positives. Questions to ask include: what is the facial recognition being used for, who is deploying the technique, what are the benefits vs risks and how many false positives is acceptable and for what type of processing. Using facial recognition as a means to open your telephone or using facial recognition to try and capture criminals are very different types of processing and therefore have different requirements.

August 2024. The Dutch Data Protection Authority (Dutch DPA) imposes a fine of 30.5 million euro and orders subject to a penalty for non-compliance up to more than 5 million euro on Clearview AI. Clearview is an American company that offers facial recognition services. Among other things, Clearview has built an illegal database with billions of photos of faces, including of Dutch people. The Dutch DPA warns that using the services of Clearview is also prohibited. Clearview has a database with more than 30 billion photos of people. Clearview scrapes these photos automatically from the Internet. And then converts them into a unique biometric code per face. Without these people knowing this and without them having given consent for this.
