This is more complicated when considering the differing users. Clinical Trials need data beyond structure coding models, as do those building AI tools. HL7 has the billing code under control. FHIR presents and good philosophical framework but does not deliver standards that increase the ability to map from one system to another. OMOP is one step beyond FHIR and provides a deeper framework to increase data useability cross-location and cross-system.

Much of the governance issues are rooted in ownership issues. We can follow HIPAA rules and use modern encryption, though who is the custodian of patent data and how do we consider ownership? If I am treated at 5 locations under 2 systems, the collective data from my visits represents my care journey but who has the right use my data? This is where complications arise which are compounded by considering in what way my data can be used. Can the data custodian allow its use as a deidentified record, can this record be used to generate derivative data products? Can these products be commercialized? If my data is remixed with other data such as credit card data, am I now at risk of being fully re-identified under commercial use?

There are 3 main branches of HIT data exchange. Without separating the end-use, the means get messy. Interoperability between systems and platforms has been in place for roughly 10 years with limited efficacy. The cloudiness around this was partially borne out due to EMR systems wanting to prevent platform switching to day we have much more availability but whole patent pictures are only present for capitated models due to the question of "who owns the data". Does the patent own data about themselves or does the system? It seems the point of care owns this data and today, treats data as a liability more than an asset. The lack of instant portability could be solved using models in banking as AML and KYC have solved for similar constraints.
