What are the best ways to avoid negotiation mistakes in real estate?

Nonsense advice AI. Way off the mark on so many levels - eg since when is it a good idea for the seller to wait for a better market or for a buyer to lower their budget as an alternative to a negotiated outcome? ??

I worked for a public agency where a failed negotiation meant an expropriation of the person's property. I found the best way to negotiate with an owner was to ensure that I had a value opinion that I could rely upon that I knew would line up with the owner's understanding of the worth of their property. It was not about getting the best deal, it was about getting a fair deal for the authority I was working for. In some cases the deal meant the owner could still fight us on value. Creativity and listening is key, what does the owner really want out of the situation?

Difficult to negotiate unless you do a due diligence assessment. For example, I do the following: 1. check the title to property, 2. Look for liens and assessments against the property and the owner, 3. Check to see if any lawsuits filed against the owner, & 4. Are the property taxes paid. Sometimes, based on my experience, I have found hidden easements and dedications that will restrict what and where the property can be developed. For vacant land I also check for utility availability. THEN, I can decide on a negotiation strategy.

Too often, agents treat other agents with hostility when an issue arises during the transaction. The most powerful way to avoid negotiation mistakes is to approach the situation using kindness and empathy. Slow down and listen to the other side.

First and foremost, make sure your clients know the process of purchasing or selling their home. Take them through the escrow process. Let them know dates are not set in stone, some things beyond your or their control can happen. Do a profile on your client so that you are aware of their needs and desires. Know your market and make sure your buyer clients are pre-approved for the homes you're showing. Disappointment sets a bad tone for your relationship with your clients when you show them property they can not afford but think you can work miracles.

Going deeper into this particular point, the Spanish author Alfred Font Barrot (The Twelve Laws of Negotiation) says that "a good landing begins with a good approximation", which means that before sitting down to negotiate with the counterparty, one must study carefully what their main and secondary objectives are, what are their motivators, and what is the form of negotiation that they usually apply. This is critical to establishing a proper starting strategy and mastering the process.

Have your standards and do not waiver from them. Know the market into which you want to invest. Never stop reading and learning. A wealthy man has a library, others have big screen tvs.

Listening with empathy and attunement and without formulating a response or reaction -- at every phase of the process -- is key. Lots of so-called negotiating pros think they're listening, but they're not. I recommend Daniel Pink's book "To Sell is Human," particularly the section about attunement. I've led my team in a few of the attunement exercises therein, which has greatly improved our negotiating skills.

One thing I have found helpful, is if you can find a way that each party can feel that they have a win in the negotiation, even if it is small. That way everyone feels good about the deal and it is much easier to work on more difficult things in the future, if needed.

Listen first. Make it a Softlanding. What I think is very important maybe it is not that important. Because of Nearshoring there are many Asian, American and European companies coming to Mexico. Every company has their different needs and timing. They come from very different places and sometimes very different industries. Price, terms and conditions are important but there are many other important issues. I need to understand their needs, their questions & expectations They speak another language. I need to explain many things in the process in order to educate, help, add value and minimize uncertainty. I need to help them start operations here in Mexico not just negotiate good price, terms and conditions. It goes farther.

Listening is always the most important. We don't read minds and all of our knowledge knowledge and expertise is by the wayside if we don't know what the client wants.
