Communication is always key. Calming the situation is paramount. Most matters can be worked out. Obviously looking at the lease first is wise. Date when you spoke or left voicemails responding to the issue. And follow up with the issue that the tenant complained about. Blowing it off is not acceptable. Address timely. Find a reasonable resolution. And communicate the progress.

As a legal advisor I would say that meticulous documentation plays a pivotal role and is key to avoiding unnecessary legal risks. Recording each interaction, from emails to conversations, with clear dates and descriptions, is an essential practice. In terms of the actual resolution of the dispute, completeness is the key. Any settlement agreement, Release, or even Lease Amendment should recite the full nature and description of what is being settled, resolved, or changed in the form of time-tested "whereas" clauses in the agreement. Having both parties bound to a written agreement/description of what their dispute was about to begin with provides clarity regarding what was agreed-to regarding those disputes and helps prevent the "unravelling" of settlements and relationships as time goes by, and memories fade.

I am of the opinion a manager should know the rights and obligations of the landlord as well as the tenant and act without delay, always knowing who the tenant is, his capabilities and intentions. If the tenant does not cooperate, then refer the handling to the landlord's legal counsel for further action. The manager's involvement must be limited to his duties, he is not responsible for drawing up and executing the rental agreement nor for resolving a dispute with the tenant. Early involvement of the owner's attorney to take appropriate action serves the owner. A manager must be demanding towards the tenant and take care of the owner's rights. In this way, the cooperation of the tenant and his compliance with his obligations are achieved.

Considering mediation or arbitration as effective methods for dispute resolution is suggested, diminishing reliance on more adversarial legal actions. Facilitating a neutral environment for both parties to express concerns and seek equitable solutions is crucial. This approach aids in minimising risks and costs associated with protracted litigation, while fostering the efficient resolution of disputes.

Having worked at the USCP I am well versed with meditation and arbitration. However, to be honest, it’s far easier to engage in rational dialogue. But if it does fail then meditation is the next best option. It’s civil. There is nothing to be afraid of and you iron out the situation. Done. Take out emotional baggage and move forward.
