Where legalities become unbalanced is when the landlord is violating the lease agreement, yet still holds the power to collect rent and not satisfy the lease agreement, forcing most tenants to live very unhappily or in unhealthy conditions since most tenants, do not want to resolve things during a legal process or even know how to.

I think the questions that need to be discussed is teaching landlords how to resolve issues at the corporate level before it ever gets to mediation. You either show that evidence to the tenant, or the tenant shows that evidence to the landlord, and ideally, they both hold up their end of the bargain .

And then the lawyers use the MSA to draft an agreed judgment or other instrument to conclude the lawsuit/dispute. Mediated agreements should always be in writing.

In my experience of renting for 20+ years the biggest issue that I see are landlords, not agreeing to the terms of their own lease agreement. Lease agreement is very cut & dry. Issues need to be communicated in writing via email. Tenants have more time to represent themselves in these cases, but it will drain the resources from corporate companies that are paying attorneys to step in to resolve an issue that certainly should’ve never happened in the first place. Again, I think education at the property management level in a leasing office or as an individual property owner is key to avoiding legalities, which by the way is very easy.
